The European Commission publishes Data Act FAQs
As organizations worldwide prepare for the new EU Data Act to take effect in September, many questions arise. The European Commission addressed some of these questions in an updated FAQs published to clarify definitions, scope, use cases, and more. This publication offers non-binding guidance.
For instance, the FAQs clarify the relationship between the Data Act and GDPR, stating that GDPR should be followed in the event of a conflict between these two regulations. Other clarifications include a list of Internet of Things (IoT) data processing use cases and how the law approaches each one, as well as how the law supports SMEs with weaker negotiation positions when shaping contractual relationships around data access.
This step by the EU highlights the need to prepare for new regulations and emphasizes the importance of companies implementing the right tools and methodologies in advance.
