Irish High Court delays operational order to TikTok during appeal

Ireland’s High Court allowed TikTok to temporarily continue its current data-transfer operations in place while it appealed a significant GDPR penalty. TikTok can continue transferring European user data to China during the appeal process. 

The ruling relates to the Irish Data Protection Commission's decision from April 30, 2025, which found repeated data privacy breaches between 2020 and 2023. The regulator considered remote access by TikTok’s China-based staff to European user data, even when the data was stored on servers in Singapore and the U.S., as an unlawful transfer. This decision resulted in a groundbreaking €530 million fine, which the company currently appeals.
